1. General Platform Terms of Ticketbande B.V.
for all users of the Ticketbande platformEffective: August 2026
§ 1 Operator and Scope
- The operator of the Ticketbande online platform is Ticketbande B.V., hereinafter “Ticketbande” or “TB”.
- The complete company, registration and contact details are available in the current legal notice.
- These General Platform Terms govern the use of the Ticketbande platform by registered and unregistered users.
- For buyers, the Ticketbande Buyer and Buyer Protection Terms also apply.
- For providers, the Ticketbande Provider Terms also apply.
- For commercial providers of search and procurement services, the Additional Terms for Search and Procurement Orders apply additionally.
- The provider’s own contractual terms apply exclusively in the legal relationship between that provider and its customer, insofar as they have been effectively incorporated.
§ 2 Role of Ticketbande
- Ticketbande operates an online marketplace for tickets, admission rights and permissible services for searching and procuring tickets.
- Ticketbande provides, in particular, technical infrastructure, offer presentation, search and comparison functions, payment processing, provider verification, ticket rating, customer service, complaint handling and fraud‑prevention measures.
- Ticketbande is, in principle, not the seller of the tickets offered through the platform.
- Ticketbande is, in principle, not the provider of search or procurement services offered by commercial users.
- The respective ticket purchase contract or search/procurement contract is concluded directly between the designated provider and the customer.
- Ticketbande is not the organizer of the offered events.
- The execution of payment processing by Ticketbande or a employed payment service provider does not change the aforementioned role distribution.
- Mandatory statutory obligations and liability of Ticketbande remain unaffected.
§ 3 User Account
- If registration is required, users must provide truthful and complete information.
- Changes must be updated promptly.
- Login credentials must be protected against unauthorized third‑party access.
- Ticketbande may request appropriate evidence for identity, security and fraud checks.
- Multiple user accounts belonging to the same person or company are permitted only with Ticketbande’s consent.
§ 4 Private and Commercial Providers
- Providers must declare whether they act privately or commercially.
- The respective status is displayed to buyers in accordance with legal requirements.
- The provider’s self‑classification is not decisive if the actual circumstances lead to a different legal assessment.
- Ticketbande may, in case of concrete indications, request appropriate evidence and verify the provider status.
Online marketplaces must, among other things, inform consumers whether a provider declares itself to be a business and, for private providers, point out that the special rules for consumer contracts generally do not apply.
§ 5 Mandatory National and International Regulations
- Providers and users must comply with all legal provisions applicable to their transactions.
- In particular, mandatory regulations of the state where the event takes place must be observed insofar as they apply to ticket resale, mediation or procurement.
- Ticketbande does not provide a complete representation of all national ticket laws in these terms.
- Ticketbande may impose additional restrictions or technical controls for specific countries, events, organizers or ticket types.
§ 6 Ranking and Ticket Rating
- Ticketbande may sort, compare and recommend offers.
- Key ranking parameters may include, in particular: price, ticket category, block, row, seat location, ticket quality, number of adjacent seats, availability, delivery method, freshness, provider reliability and relevance to the specific search query.
- If paid highlights affect visibility, they will be disclosed in accordance with legal requirements.
- Ticketbande provides the legally required detailed information about main parameters and their relative importance separately and in an easily accessible manner.
The disclosure of essential ranking parameters is provided for both consumer marketplace law and P2B law.
§ 7 Illegal Content and Offers
- Users may not publish illegal, fraudulent or misleading offers or content.
- Ticketbande provides an electronic means to report allegedly illegal content.
- Ticketbande may remove, deactivate or limit the visibility of illegal or non‑compliant content.
- Statutorily required justification and complaint options remain available.
The DSA, among other things, provides for an electronic reporting procedure and imposes special obligations on online marketplaces to identify commercial providers.
§ 8 Suspension and Restriction
Ticketbande may temporarily or permanently restrict user accounts or individual functions, in particular in cases of suspected fraud, false identity information, illegal offers, repeated non‑performance, counterfeit tickets, significant security risks or other material breaches of contract.For commercial users, the mandatory P2B requirements regarding justification, restriction and termination are taken into account.
§ 9 Data Protection
Personal data are processed in accordance with applicable data‑protection regulations. Details are set out in the current Ticketbande privacy policy.§ 10 Liability of Ticketbande
- Ticketbande is liable without limitation for intent, gross negligence, culpable injury to life, body or health, and in other cases of mandatory statutory liability.
- For slight negligence in breach of essential contractual obligations, liability is limited to foreseeable, contract‑typical damage.
- Ticketbande is generally not liable for the provider’s breaches of duty arising from the contract between provider and customer.
- The provision of Ticketbande buyer protection does not make Ticketbande the seller or guarantor of the performance owed by the provider.
§ 11 Choice of Law and Jurisdiction
- The legal relationship with Ticketbande is generally governed by German law.
- This does not deprive consumers of the mandatory protection of the law of their habitual residence.
- For consumers, the statutory courts apply.
- For business customers, where legally permissible, the jurisdiction relevant to Ticketbande may be agreed upon.
2. Ticketbande Buyer and Buyer Protection Terms
These terms apply to buyers and clients.§ 1 Buyer’s Contractual Partner
- The contract for the ticket or the search/procurement service is concluded, in principle, between the provider indicated in the offer and the buyer or client.
- Before concluding the contract, it is indicated whether the provider acts privately or commercially.
- For a private provider, it is pointed out that the special consumer protection provisions for business‑consumer contracts generally do not apply.
- If a commercial provider effectively incorporates its own terms and conditions, they are made accessible to the customer before the customer makes a binding declaration.
§ 2 No Buyer Fee
- Ticketbande does not charge the buyer any platform, mediation, payment processing or buyer protection fee.
- The buyer pays only the total amount indicated during the ordering process under his contract with the provider.
- The Ticketbande buyer protection is part of the platform processing for the buyer at no additional charge.
§ 3 Payment Processing
- The payment is processed via a payment service provider employed by Ticketbande.
- The payment fulfills the buyer’s payment obligation to his respective contractual partner.
- The technical payment processing does not make Ticketbande the seller of the ticket.
§ 4 Ticketbande Buyer Protection
Ticketbande supports buyers in particular by:a) monitoring ticket delivery within technical possibilities,
b) contacting the provider in case of delivery problems,
c) examining complaints,
d) assistance with ticket transfer,
e) offering suitable replacement tickets where possible,
f) handling refunds in the cases regulated below.
§ 5 Non‑Delivery
- If the provider fails to deliver the owed ticket, Ticketbande will, where possible, first try to offer a suitable replacement solution.
- If no suitable replacement can be provided, the buyer receives 100 % of the amount paid for the transaction back.
- Ticketbande does not charge any cancellation or processing fee for this.
- A misdelivery or subjective dissatisfaction with a delivered ticket does not automatically constitute non‑delivery.
§ 6 Misdelivery
- In case of an alleged misdelivery, it is examined whether the provided ticket deviates from the objectively agreed characteristics.
- Relevant are, in particular, the event, date, number of tickets, seat or standing place and category, as expressly agreed special characteristics.
- A purely subjective lower rating of a seat does not constitute non‑delivery if the objectively agreed features have been met.
- The buyer’s statutory rights against the provider remain unaffected.
§ 7 Invalid or Blocked Tickets
- The provider is fundamentally responsible for the validity and proper provision of the ticket.
- If the buyer is denied entry because the ticket is demonstrably invalid or blocked, Ticketbande examines the case.
- Ticketbande may, in particular, request a written or electronic confirmation from the organizer, venue or original ticketing company.
- If, after examination, it is sufficiently clear that the invalidity or blockage originates from the provider’s responsibility or risk sphere, the buyer generally receives 100 % of the amount paid back.
- The refund by Ticketbande does not mean that Ticketbande assumes the provider’s seller liability.
§ 8 Buyer‑Caused Blocking
There is no claim under the buyer protection insofar as the buyer has culpably caused the blocking or unusability of the ticket.This applies in particular if the buyer:
- QR‑Codes,
- Barcodes,
- Ticket numbers,
- complete ticket screenshots,
- wallet or transfer data,
- access codes,
- account or login data
makes them accessible to unauthorized third parties and thereby causes or enables multiple use, blocking or other impairment.
§ 9 Withdrawal
- Whether a right of withdrawal exists depends on the type of contract and the statutory provisions.
- If a statutory or expressly granted right of withdrawal exists and is exercised effectively, the customer generally receives 100 % of the amount to be refunded.
- Ticketbande does not charge any own processing or cancellation fee for a validly exercised right of withdrawal.
- Statutorily permissible compensation for value for already commenced services remains unaffected.
- If a statutory electronic withdrawal function is required, Ticketbande provides it in accordance with legal requirements.
Section 356a BGB has required, since 2026, a prominently visible electronic withdrawal function for the covered online distance contracts.
§ 10 Cancellation or Rescheduling of an Event
- Ticketbande is not the organizer.
- For a commercial provider, the legal consequences of a cancellation or rescheduling are governed by the contract with the provider, its effectively incorporated terms and conditions, and mandatory statutory provisions.
- For private providers or where provider terms have not been effectively incorporated, the statutory and individual contractual regulations apply.
- Ticketbande does not charge any own buyer fee solely for handling a cancellation or rescheduling.
§ 11 Ticket Transfer
- Tickets can be transferred, in particular, as mobile transfer, e‑ticket, wallet ticket, via an organizer app, by post or by any other permissible method.
- Mobile tickets are considered delivered when the agreed admission right has been successfully transferred to the buyer’s designated account and accepted by the buyer, unless specific circumstances prevent this.
- Buyers must perform required cooperation actions, in particular the acceptance of a transfer, in a timely manner.
3. Ticketbande Provider Terms
for private and commercial sellers§ 1 Scope
- These terms govern the relationship between Ticketbande and users who offer tickets or permissible services on Ticketbande.
- The General Platform Terms apply additionally.
- For commercial search/procurement providers, the special additional terms also apply.
§ 2 Provider Status
- Providers must truthfully declare whether they act privately or commercially.
- Commercial providers must provide all identity and company information requested by Ticketbande or the payment service provider.
- Ticketbande may, in particular, request name, address, contact details, identity proof, payment account and registration data.
Article 30 DSA requires, for relevant online marketplaces, the collection of certain information from commercial providers before they use the platform towards EU consumers.
§ 3 Permissible Tickets
- Providers may list only tickets they lawfully possess and can transfer under the contract.
- All essential ticket characteristics must be fully and accurately disclosed.
- Known personalization, transfer or usage restrictions must be indicated.
- Counterfeit, already definitively sold elsewhere or knowingly invalid tickets may not be offered.
§ 4 Price and Legal Restrictions
- Ticketbande does not generally set an own price ceiling for ticket offers.
- The provider must, however, observe all mandatory legal price and resale restrictions.
- When reselling an admission right, the provider must state the original price set by the organizer, insofar as legally required and available.
The corresponding marketplace information obligation for Germany is expressly derived from Art. 246d § 1 No. 7 EGBGB.
§ 5 Ticketbande Fee
Commercial providersThe Ticketbande fee is generally:
30 % net of the total transaction final price.
Private providers
The Ticketbande fee is generally:
30 % gross of the total transaction final price.
- The debtor of the Ticketbande fee is exclusively the provider.
- The specific tax treatment is taken into account in the respective billing or invoicing.
- The terms deliberately contain no further general statements about the tax treatment of individual providers.
§ 6 Assessment Base
- The Ticketbande fee is calculated on the total final price of the relevant transaction.
- For ticket sales, this includes all amounts owed by the buyer for the offer.
- For search/procurement orders, the assessment base especially includes the amount allocated or spent for the ticket, the search/procurement remuneration and any further fees demanded by the provider.
§ 7 Payment Processing and Provider Claim
- Customer payments are processed via the payment service provider employed by Ticketbande.
- Ticketbande or the payment service provider is entitled to withhold the payout to the provider until successful verification of the performance.
- The payout is made after deduction of the Ticketbande fee, any security reserves and other due and set‑offtable claims.
§ 8 Risk Classification and Payout
- Ticketbande uses a risk‑based payout model.
- Providers can be assigned to different risk classes depending on their individual risk profile.
- The classification may particularly consider:
- Duration of the business relationship,
- Number and volume of successfully completed sales,
- Delivery rate,
- Complaint rate,
- Chargebacks,
- Cases of invalid tickets,
- Type and value of tickets,
- Verifiability of ticket transfer,
- Open future transactions,
- Existing security reserves,
- Identity and company verification.
Reliable and known providers
- For reliably classified providers, the payout can occur immediately after successful and verified delivery.
- For mobile tickets, verified delivery may especially be present when tickets are successfully transferred via the official transfer system into the buyer’s account and accepted there.
New or unknown providers
- For new or not yet sufficiently assessable providers, Ticketbande may generally withhold payout until after the event has taken place.
Flagged or problematic providers
- For providers with elevated risk, especially after non‑deliveries, invalid tickets, significant complaints or chargebacks, the payout may also be withheld until after the event or until final clarification.
- A provider has no entitlement to be placed in a particular risk class or to an early payout.
§ 9 Security Reserve
- Ticketbande or the employed payment service provider may retain a security reserve to cover open transaction, refund and chargeback risks.
- Under the current payment structure, a reserve of up to 30 % of the transaction volume for a period of up to six months may be provided.
- Deviating individual arrangements with specific providers or changes due to the employed payment service provider remain possible.
- The reserve particularly serves to secure:
- Chargebacks,
- Refunds,
- Non‑deliveries,
- Invalid tickets,
- Other reversals and
- Due claims of Ticketbande.
§ 10 Set‑off
Ticketbande is entitled to set‑off due claims against a provider with:- current payout claims,
- security reserves,
- future payout claims from further transactions
to the extent legally permissible.
§ 11 Non‑Delivery
- A provider is obliged to deliver a sold ticket in accordance with the contract.
- If the provider fails to deliver for a reason attributable to him, Ticketbande may reverse the transaction and refund the buyer the amount paid.
- Ticketbande may claim from or set‑off against the responsible provider an amount of up to 15 % of the total final price of the relevant transaction for the additional effort and incurred costs.
- Allowable expenses may particularly include: payment and reversal processing, customer service, repeated contact with the provider, transaction verification and the search for replacement tickets.
- The provider retains the burden of proof that no or only a significantly lower effort or damage has arisen.
§ 12 Invalid or Blocked Tickets
- The provider is responsible for the contractual validity and transferability of the tickets he sells.
- If a buyer is denied entry due to a deficiency originating from the provider’s responsibility or risk sphere and Ticketbande refunds the buyer the purchase price, Ticketbande may reclaim or set‑off the corresponding amount from the provider.
- The provider is given the opportunity to respond to a complaint and provide appropriate evidence.
§ 13 Provider Terms towards Buyers
- Commercial providers may upload their own terms and consumer information.
- These apply exclusively in the contractual relationship between provider and customer and only when effectively incorporated.
- The provider is responsible for the content, currency and legality of his own contractual conditions.
- Ticketbande provider terms may not be altered by the provider’s own terms.
§ 14 Cancellation and Rescheduling
The provider must fulfill all obligations towards his buyers concerning event cancellations and rescheduling in accordance with his contract, his effectively incorporated terms and the mandatory law.§ 15 Indemnification
The provider indemnifies Ticketbande against legitimate third‑party claims insofar as they arise from an unlawful or contract‑breaching use of the platform attributable to the provider.4. Additional Terms for Commercial Search and Procurement Providers
§ 1 Scope
These additional terms apply exclusively to commercial providers who offer search and procurement services for tickets on Ticketbande.Private providers may not offer search/procurement orders.
§ 2 Distinction from Ticket Resale
- A search/procurement order may only be offered if, at the time of contract formation, the sought ticket is not in the possession or control of the provider.
- The contract concerns the search or procurement of a ticket that does not yet exist.
- An already existing ticket may not be declared as a search order.
- Search/procurement orders may not be used to circumvent mandatory legal price, sale or resale restrictions.
§ 3 Service Description
The provider must, before contract formation, transparently specify in particular:- Event,
- Number of tickets,
- Desired category,
- Where applicable block/row/seat requirements,
- Price limits,
- Search/procurement remuneration,
- Conditions for the emergence and due date of this remuneration,
- Other relevant costs.
§ 4 No Success Guarantee
Unless expressly agreed otherwise, a search/procurement order does not guarantee that a suitable ticket can be found.§ 5 Acquisition of the Ticket
- If a suitable ticket is found, the acquisition proceeds according to the contract concluded with the client.
- Where technically and legally possible and contractually stipulated, the acquisition should be made in the name or on behalf of the client.
- The ticket price and search/procurement remuneration must be presented transparently.
§ 6 Withdrawal and Consumer Information
- For search/procurement contracts with consumers, the provider must independently assess whether and to what extent a statutory right of withdrawal exists.
- If the service is to commence within an existing withdrawal period, the provider must obtain the required statutory declarations and consents.
- A possible lapse of the withdrawal right and any compensation are governed solely by statutory requirements.
- The provider must make the necessary information and instructions available before contract formation.
§ 7 Ticketbande Fee
The standard provider fee applies to search/procurement orders.For commercial providers, this is generally 30 % net of the total final price of the transaction.
The assessment base is, in particular:
Ticket acquisition amount + search/procurement remuneration + other charges billed to the customer.
The calculation of the Ticketbande fee on the total final price does not alter the legal classification of the individual contractual components between provider and client.
§ 8 Proof Obligations
Ticketbande may request appropriate evidence for search/procurement orders, in particular regarding:- Time of the search order,
- Time of acquisition,
- Origin of the ticket,
- Original purchase price,
- Ticket transfer,
- Acquisition in the name or on behalf of the customer.
